1. Definitions

1.1. User – a natural or legal person who has registered in NEBS and uses its services.

1.2. Personal Account – the User's personal section in NEBS, accessed by means of a login and password.

1.3. Event – a cultural, entertainment, educational, scientific, sporting or other event (including performances, concerts, exhibitions, festivals, film screenings, lectures, conferences, etc.), attendance of which is based on a ticket, including a ticket issued in electronic form.

2. General Provisions

2.1. The subject matter of this Agreement is the provision to the User of access to NEBS services.

2.2. The Agreement is deemed concluded from the moment of the User's registration in NEBS.

2.3. By registering in NEBS, the User confirms that they have read and agree to all the terms of this Agreement.

2.4. The Administrator may amend and supplement this Agreement without prior notice to Users. Amendments take effect from the moment of their publication in NEBS.

2.5. Continued use of NEBS after amendments have been made constitutes the User's consent to the new version of the Agreement.

3. Rights and Obligations of the Administrator

3.1. The Administrator undertakes to:

3.1.1. Ensure the operation of NEBS within the limits of the available organizational and technical capabilities.

3.1.2. Take the measures provided for by the legislation of the Kyrgyz Republic to protect the information and personal data of Users.

3.1.3. Ensure the safekeeping of the electronic data necessary for the operation of NEBS.

3.2. The Administrator has the right to:

3.2.1. Restrict, suspend or terminate the User's access to NEBS in the event of violation of the terms of this Agreement.

3.2.2. Carry out preventive, technical, emergency recovery and other works that temporarily restrict access to NEBS.

3.2.3. Remove information posted in violation of the legislation of the Kyrgyz Republic.

3.2.4. Change the structure, interface, composition of services and functionality of NEBS without obtaining the consent of Users.

3.2.5. Refuse registration or terminate the User's access to NEBS in order to ensure information security and the stable operation of the system.

3.2.6. Request from the User additional information necessary for identification and for ensuring the security of the use of NEBS.

3.2.7. Use anonymized statistical data generated in the course of the operation of NEBS for the purposes of analysis, reporting and improvement of the system.

3.3. The Administrator does not guarantee the uninterrupted, continuous and error-free operation of NEBS.

4. Rights and Obligations of the User

4.1. The User undertakes to:

4.1.1. Use NEBS solely for lawful purposes.

4.1.2. Refrain from actions aimed at disrupting the operation of NEBS.

4.1.3. Not disclose their account credentials to third parties.

4.1.4. Comply with the requirements of the legislation of the Kyrgyz Republic on copyright and related rights.

4.1.5. Not carry out automated collection, copying or distribution of information from NEBS without the appropriate authorization.

4.1.6. Not post information that is contrary to the legislation of the Kyrgyz Republic.

4.1.7. Not attempt unauthorized access to NEBS, its software, databases and other information resources.

4.1.8. Immediately notify the Administrator of any loss of account credentials or of any detected instances of unauthorized access.

4.1.9. Provide accurate information at registration and keep it up to date.

4.2. The User has the right to use NEBS services in accordance with this Agreement.

5. Personal Data

5.1. The User consents to the processing of their personal data to the extent necessary for the operation of NEBS.

5.2. Personal data is processed in accordance with the legislation of the Kyrgyz Republic.

5.3. The User confirms the accuracy of the personal data provided and is responsible for keeping it up to date.

5.4. The Administrator has the right to process personal data for the purposes of ensuring the operation of NEBS, complying with the requirements of the legislation of the Kyrgyz Republic and ensuring information security.

6. Intellectual Property

6.1. The exclusive rights to the NEBS software, databases, design, interface and other intellectual property belong to the Administrator or other rightholders.

6.2. The use of intellectual property is permitted only to the extent provided for by the legislation of the Kyrgyz Republic.

6.3. The posting of materials in NEBS does not constitute a transfer to the User of any property rights to such materials.

7. Liability of the Parties

7.1. The Parties bear liability in accordance with the legislation of the Kyrgyz Republic.

7.2. The Administrator is not liable for: – temporary unavailability of NEBS; – interruptions in the operation of communication networks, internet service providers and the User's equipment; – actions of third parties; – the accuracy, currency and completeness of information posted by event organizers; – the cancellation, postponement or change of the terms of events; – the quality of services provided by event organizers; – losses incurred by the User as a result of the use of, or the inability to use, NEBS.

7.3. The Administrator ensures the operation of NEBS solely as a state information system and is not an event organizer, ticket seller, agent, commission agent or a party to contracts concluded between event organizers and visitors.

7.4. All obligations related to the holding of events, refunds for tickets, and changes to the date, time or venue of an event are borne by the respective event organizer.

8. Termination of Access

8.1. The User may stop using NEBS at any time.

8.2. The Administrator may, without prior notice, restrict, suspend or terminate the User's access to NEBS, and block or delete the User's account, in the event of a violation of this Agreement or of the requirements of the legislation of the Kyrgyz Republic, or where there is a threat to information security.

8.3. Deletion of the account does not release the User from liability for previously committed violations.

9. Force Majeure

9.1. The Parties are released from liability for the non-performance or improper performance of their obligations under this Agreement resulting from force majeure circumstances that the Parties could not have foreseen or prevented.

10. Final Provisions

10.1. This Agreement is governed by the legislation of the Kyrgyz Republic.

10.2. All disputes and disagreements shall be resolved through negotiations.

10.3. If no agreement is reached, the dispute shall be considered by a court in accordance with the legislation of the Kyrgyz Republic.

10.4. If individual provisions of this Agreement are found to be invalid, this shall not entail the invalidity of the remaining provisions of the Agreement.
